Cortland County joined other New York State County Courts in ruling that that § CPL 30.30(1)(a) applies to traffic tickets. Criminal Procedure Law § 30.30 requires that the People tell the Court they are ready for trial within 30 days of when the charging instruments were filed in court. Previous county courts ruling in the same manner were the Clinton County Court, Wayne County Court, and Essex County Court.
Defendant was stopped for speeding on Interstate 81 in October of 2023. He was charged with speeding 90 miles per hour in a 65 mph zone. The ticket was made answerable to the Cortlandville Town Court. After plea negotiations did not result in a plea deal, the case went to trial. Defendant was found Guilty and subsequently appealed his conviction to the Cortland County Court. In a Decision dated December 30, 2024, Hon Julie Campell, County Court Judge, ruled that the conviction should be overturned and further ordered that the ticket should be dismissed.
