Vehicle & Traffic Law § 1125(a)3 “Drove to Left Bridge/Tunnel”

One of the rarest tickets issued in New York State is for violating VTL § 1125(a)3. This statute is of many that relate to the general requirements that wherever possible motorists stay in the right hand lane wherever there are multiple lanes of traffic. VTL 1125-a-3 puts an additional onus on motorists that are approaching a bridge or tunnel that are causing views to be obstructed. If the motorist fails to move to the right, which would give them better views, they would be in violation of 1125a3. A conviction of this violation would put three points on the ticketed motorists’ driving record and they would be facing a fine of up to $243. Most importantly, if this violation appears on a driving record they can expect to see their vehicle insurance rates go up for several years.

Fighting a 1125(a)3 Traffic Ticket

In New York State, attorneys are generally permitted to attend court in the place of their clients for run-of-the-mill traffic tickets. The Defendant would just have to sign a Waiver and Authorization form that would allow their attorney to enter a plea on their behalf. This means you can get your charges dismissed or reduced without having to take time off from work or leaving your home to attend court.

When considering retaining counsel for your traffic-related charges there are two aspects to review. (1) Where the lawyer is located in proximity to the relevant courthouse. Some courts are in rural areas and it is difficult to find a local lawyer. If you get a traffic ticket in a city, there will likely be many local attorneys that practice traffic law. (2) The percentage of the law firm’s practice that is dedicated to Vehicle & Traffic Law. The number should be 75% or higher.
